WHAT IS MISSISSIPPI'S CURRENT CANNABIS MARKET STATUS?
In 2014 cannabis in the form of CBD was legalized for patients with seizure-causing illnesses in the State of Mississippi. As of November 3, 2020, medical cannabis was passed by voters, which will allow qualified patients with debilitating medical conditions, as certified by Mississippi licensed physicians, to use medical marijuana. This Amendment will allow medical marijuana to be provided only by licensed treatment centers. The Mississippi State Department of Health will regulate and enforce the provisions of this amendment.
Currently, there is a pending court date of April 14, 2021, when the Supreme Court will hear arguments between Madison Mayor, Mary Hawkins Butler, and Secretary of State, Michael Watson, to decide if Initiative 65 was unconstitutional.
SB 2765 was introduced and later killed by a vote conducted by the full House of Representatives on March 10, 2021. The motion leaves medical cannabis at the mercy of the Mississippi Supreme Court. If the Supreme Court rules in favor of the voter-approved Initiative 65, regulations are required to be released by July 1, 2021, and identification cards to patients by August 15, 2021.
WHAT ARE MISSISSIPPI'S CANNABIS LAWS?
In April 2014 Governor Phil Bryant signed into law HB1231, Harper Grace's Act. This law allows for the production of CBD for medical purposes. CBD oil can only be obtained by the order of a physician who is licensed to practice in Mississippi. Administering CBD oil to a patient must be done by, or under the direction or direct supervision of a physician. The CBD oil must be obtained from, or tested by the National Center for Natural Products Research at the University of Mississippi, and dispensed by the Department of Pharmacy Services at the University of Mississippi Medical Center. Harper Grace's Law created more restrictive rules that exist in any of the states that currently have legalized medical cannabis.
Mississippi voters passed Amendment 65 with a 68% vote. Voters also indicated a preference for Amendment 65 rather than Amendment 65A, which would have given state lawmakers more control over key regulations. Now that Amendment 65 has passed, a medical marijuana program permitting patients diagnosed with specific serious health conditions with the recommendation of their doctor will have access to medical marijuana.

WHAT IS MISSISSIPPI'S CANNABIS LICENSING TIMELINE & CANNABIS APPLICATION PROCESS?
Assuming the voters of Mississippi don’t overturn Initiative 65, the Mississippi Department of Health has a target date of August 15, 2021 for the application process. Initiative 65 has a requirement that all regulations for the program must be in place by July 1, 2021.
WHAT IS THE HISTORY OF CANNABIS IN MISSISSIPPI?
Cannabis has been illegal in Mississippi since the early days of prohibition in the 1920s. However in 1978 small possessions of cannabis were decriminalized. Decriminalization still means possession is a misdemeanor; however, if it is a first offense there will be no jail time. In 2014 CBD was legalized for patients with qualifying conditions; however, there were criticisms that the laws restricted access to purchase CBD since the laws were so strict on who could produce CBD.
